Cathay Land Inc (CLI) ordered Tokyo Mansions SFTMHOAI a Cease and Desist Order for Constructing a Basketball Court

As homeowners of South Forbes Tokyo Mansions are deprived of the enjoyment in using our amenities such the village swimming pool and a nice functional clubhouse due to our dispute with Cathay Land Inc. (CLI) on the turnover of the village amenities and facilities, the 2019 Board of Directors of SFTMHOAI upon the request of homeowners decided to construct at its own expense and initiative a basketball court (a multipurpose court that can be a volleyball, tennis, and basketball court) in the open areas designated as parks in the subdivision plan. If our teenagers cannot swim in the pool, they can at least play basketball for the meantime and use our open spaces. Some Tokyo Mansions homeowners actually play basketball in neighboring villages such as in Nuvali, Westgrove, and other villages in Laguna.

Cathay Land Inc. (CLI) objected to this construction and alleged that SFTMHOAI intentionally damaged the said open areas, for all intents and purposes. CLI sent a demand letter ordering a cease and desist order for the construction stating the SFTMHOAI are trespassers in the village. SFTMHOAI stand is that they cannot be blamed for the construction of the said basketball court, because CLI has been remised in their obligation to provide the lot owners and to SFTMHOAI proper recreational facilities. The clubhouse and the swimming pool remained unfinished as it deteriorated during their incumbency when they were managing the affairs of the village, which basically robbed the SFTMHOAI hundreds of thousand if not millions of lost income as a result. In addition, before the SFTMHOAI started with the construction of the said basketball court, its officers informed CLI’s representatives of the same.
